These Terms and Conditions govern the relationship between Pesona Wira and individuals who engage our watch service and repair programmes. By submitting an enquiry or bringing a timepiece for service, you agree to the terms set out below.
Definitions
Throughout these Terms and Conditions, the following terms carry the meanings assigned below:
- "We / Us / Our" — Pesona Wira, a watch repair workshop operating from 51 Jalan SS 2/24, 47300 Petaling Jaya, Selangor.
- "You / Client" — any individual who engages our services or uses our website.
- "Service" — any watch repair, servicing, or related programme offered by Pesona Wira.
- "Timepiece" — the watch or watch component entrusted to us for service.
- "Agreement" — these Terms and Conditions, together with any service quotation or intake documentation issued by us.
- "Website" — the website operated at pesonawi.site.
Acceptance of Terms
By submitting an enquiry through our website, contacting us directly, or delivering a timepiece for service, you acknowledge that you have read and understood these Terms and agree to be bound by them.
You confirm that you are at least 18 years of age and have the legal capacity to enter into this Agreement. If you are acting on behalf of another person or business, you confirm that you have the authority to do so.
If you do not agree to these Terms, you should not submit an enquiry or engage our services.
Service Description
Pesona Wira provides professional watch repair and servicing in Petaling Jaya, Selangor. Our programmes include:
- Service & Regulation Programme — full movement disassembly, cleaning, lubrication, and regulation (MYR 950)
- Bracelet Service — clasp servicing, link refinishing, and pin renewal (MYR 700)
- Comprehensive Service Programme — full movement service combined with case, bracelet, dial, and sealing work (MYR 2,150)
All services are provided in-workshop at our Petaling Jaya premises. Remote or postal service is not offered at this time. Services are available to clients within Malaysia only.
We reserve the right to decline any service where, in our professional assessment, carrying out the work would not be in the best interest of the timepiece or its owner.
Client Responsibilities
You agree to the following when engaging our services:
- Provide accurate and complete information about the timepiece, including any known damage, prior repairs, or unusual conditions.
- Disclose any sentimental or financial significance that may affect service decisions.
- Confirm ownership of, or authorisation to submit, the timepiece for service.
- Respond to communications from our workshop within a reasonable timeframe.
- Collect the timepiece within 30 days of notification that work is complete. Storage beyond this period may attract additional charges.
- Not use our website for any unlawful purpose or in a manner that disrupts service delivery.
Intellectual Property
All content on our website, including text, imagery, design elements, and technical documentation, is the property of Pesona Wira or our licensed suppliers. No content may be reproduced, distributed, or used commercially without prior written consent.
Photographs of your timepiece taken during the service process remain the property of Pesona Wira for internal documentation purposes. We will not use identifiable client property photographs for marketing without your express consent.
Payment Terms
All prices are quoted in Malaysian Ringgit (MYR) inclusive of applicable taxes. Prices listed on our website are indicative; a confirmed quotation is provided following intake assessment.
- Work commences only upon written confirmation of the quotation by the client.
- Payment is due in full upon collection of the timepiece.
- We accept cash and bank transfer. Other payment methods will be confirmed at quotation stage.
- Where parts sourcing results in cost changes, the client will be notified and must confirm before work continues.
Cancellation and Refunds
You may withdraw from the service agreement before work has commenced at no charge. Once disassembly has begun, a partial fee reflecting work completed may apply. If you choose not to proceed following inspection, a diagnostic assessment fee of up to MYR 150 may be charged to cover the intake examination.
Refunds for completed work are not provided where the service was carried out in accordance with the agreed scope. If you believe the work was not performed as agreed, contact us at [email protected] and we will seek to resolve the matter in good faith.
Service-Specific Terms
The following terms apply specifically to our repair and servicing programmes:
- Timelines provided are indicative. Complex or rare calibres, and parts sourcing, may extend the service period. We will communicate delays as soon as they are identified.
- Refinishing decisions — particularly regarding vintage surfaces — will be confirmed with the client before execution.
- Replacement parts are sourced through manufacturer channels where possible. In cases where original parts are unavailable, alternatives will be discussed with the client before installation.
- We do not accept responsibility for pre-existing damage discovered during disassembly that was not disclosed or apparent at intake.
- Post-service rate performance is subject to normal mechanical variation and cannot be represented as absolute.
Confidentiality
Service records, including details of your timepiece and correspondence, are held in confidence and not disclosed to third parties except as required by law or with your consent.
Disclaimers
Our website and its contents are provided on an "as is" basis. While we take reasonable care with the accuracy of information presented, we do not warrant that all content is current, complete, or error-free.
Watch repair outcomes are subject to the condition of the timepiece at intake, availability of parts, and the inherent variability of mechanical movements. We do not represent or imply specific performance results following service.
Nothing on our website constitutes professional advice of any kind beyond the scope of horological service.
Limitation of Liability
To the fullest extent permitted by Malaysian law, Pesona Wira's total liability arising from any service engagement shall not exceed the total fees paid for that specific service.
We are not liable for indirect, consequential, special, or incidental losses including lost profits, loss of use, or diminution in value arising from a service outcome, except where such liability cannot be excluded under the Consumer Protection Act 1999 (Malaysia) or other applicable legislation.
In the event of loss or accidental damage to a timepiece while in our care, our liability is limited to the fair market value of the timepiece at the time of intake, subject to independent valuation where applicable.
Indemnification
You agree to indemnify and hold harmless Pesona Wira, its staff, and representatives from any claims, losses, or expenses arising from your breach of these Terms, misrepresentation of ownership, or provision of false or misleading information in connection with a service engagement.
Termination
Either party may end a service arrangement before work commences without penalty. Once work has begun, termination by the client will result in a partial fee as described in Section 06.
We reserve the right to decline service or discontinue work where a client has misrepresented information, behaved unreasonably, or where completing the work would be harmful to the timepiece. Sections 05, 09, 10, and 12 survive any termination of this Agreement.
Dispute Resolution
These Terms are governed by the laws of Malaysia. Any disputes arising from or connected with this Agreement shall be subject to the jurisdiction of the courts of Selangor, Malaysia.
We encourage clients to raise any concerns directly with us in the first instance. Most matters can be resolved informally through open communication. Contact us at [email protected].
Where informal resolution is not achievable, parties may refer the dispute to mediation through the Malaysian Mediation Centre before pursuing court proceedings.
General Provisions
- Entire Agreement — These Terms, together with any service quotation, constitute the full agreement between the parties.
- Severability — If any provision is found to be unenforceable, the remaining provisions continue in full force.
- Waiver — Failure to enforce any right under these Terms does not constitute a waiver of that right.
- Assignment — You may not assign your rights or obligations under this Agreement without our prior written consent.
- Notices — Formal notices should be sent in writing to our address or to [email protected].
Changes to These Terms
We may revise these Terms from time to time. Any material changes will be published on this page with an updated effective date. Continued use of our website or services after such changes constitutes acceptance of the revised Terms. We recommend reviewing this page periodically.
